Notification of Copyright under the Digital Millennium Copyright Act

Risk of Loss
All items purchased from Think Greener, LLC are made pursuant to a shipment contract. This means that the risk of loss and title for such items pass to you upon our delivery to the carrier.

However, Think Greener, LLC does not warrant that product descriptions or other content of any Think Greener, LLC Service is accurate, complete, dependable, current, or error-free. If a product offered by Think Greener, LLC itself is not as described, your sole remedy is to return it in unused condition.
Pricing and Payments
Think Greener, LLC rates all products monthly or one-time fees unless otherwise agreed upon. The customer understands this is our service fee and this fee will apply for all completed sales of services or products regardless of whether the customer declines further services after analysis or declines to purchase parts/services required in completing any packages. Think Greener, LLC rates for the services or products you select are provided to you and are available on the Think Greener, LLC Website unless otherwise provided in this Agreement. You agree to pay the charges applicable to your selected service or product, as well as any, applicable taxes and other charges including but not limited to initial fees. You also agree to pay any additional fees applied to your billing account for any reason, including but not limited to, interest, and charges due to insufficient credit or insufficient funds.
Think Greener, LLC will make every reasonable attempt to troubleshoot, analyze, assess, correct, or otherwise consult with you to analyze your sustainable or renewable needs. If Think Greener, LLC is unable to resolve your technical problems, you are still liable for any fees for time spent by Think Greener, LLC in any attempt to consult with you about your needs. All payments are expected immediately upon the purchase of products or beginning of the Consulting Service. The Website will calculate the total amount due based on the service or product fee.
Limitation on Liability
Customers agree to release, indemnify, and hold harmless Think Greener, LLC, any employee, subcontractor or consultant of Think Greener, LLC responsible in any way from liability for any claims for damages of any kind or description that may arise directly or indirectly from the services performed.
In no event shall Think Greener, LLC and/or its respective suppliers, vendors, partners, or affiliates be liable for any consequential, direct, incidental, indirect, punitive, special or other failure or functionality of any and all hardware or software associated with The customer’s computer, peripherals or data storage device, including any failure that occurs while attempting repair, similar damages or any damages resulting from loss of use, or loss of data, whether in an action of contract, negligence or other tortuous action, arising out of or in connection with the use or performance of materials or services available from the site, even if the possibility of such damages could have been foreseen by Think Greener, LLC.
To the extent permitted by law, you agree that Think Greener, LLC total liability for damages related to its services is limited to the total amount you pay for the services, and you release Think Greener, LLC from liability for any indirect, incidental, special, or consequential damages. Think Greener, LLC is not liable for loss, alteration, or corruption of any data or for your inability to use your computer equipment or other product. Think Greener, LLC is not responsible for any injuries sustained by users because of or as a result of any service.
